What is liability? It means that one is obligated to pay.
What are damages? They are the losses you suffered, as well as any future losses you may experience, as the result of the
accident. Damages usually include: medical bills, lost wages, pain & suffering, and property damage.
What is Pain & Suffering? Pain is the physical pain your body experiences as a result of the accident, and suffering is the
limitation in lifestyle you experience as a result of your pain. Example: Because of the pain in your back you couldn't go out to the
movies with your friends. Your back pain is the pain, and your not being able to go to the movies with your friends is the suffering.
How much is my case worth? The value of your case depends upon the seriousness of your injuries, with more serious injuries
being worth more than minor ones. At the beginning of your case, the seriousness of your injuries are unknown, and therefore
the value of your case is also unknown. Once your injuries are known, the value of your claim will be based upon the amount you
could recover from a jury at trial.
How long will it take to resolve my claim? We cannot begin to process your claim until you are released from medical
treatment. Once you are released from medical treatment, it generally takes three to four (3-4) months to settle your claim. If
your claim does not settle, then we will review your claim for litigation.
What is litigation? Litigation is the process of resolving your claim by using the Court System. It begins with filing a Complaint
with the Superior Court and usually ends with an Arbitration or Jury Trial. An Arbitration is like a mini-trial, except that there is no
jury and an independent attorney takes the place of the judge. An Arbitration can usually be appealed to a Jury Trial.
